1. SUBMISSIONS: If you are not at least 18 years of age, you must have permission from your parent or guardian in order to submit material. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT SUBMIT ANY MATERIAL TO FOOTBALL FANATICS. Football Fanatics may change these terms at any time by posting changes online. You must review these terms regularly to ensure you are aware of any changes made by Football Fanatics. By submitting your photo, you attest that your photo is your own original work and you have the right to grant the rights described below to Football Fanatics; was not produced by you in the course of your employment; does not infringe upon any statutory copyright or upon any common law right, proprietary right, or any other similar right of any third party; does not violate any law, including by the manner in which it was obtained or created; is not libelous, defamatory or obscene; was not taken by any hidden, surreptitious or illegal means or any other method that violates another person's privacy or publicity rights; where it includes images of children under age 16, the images have been obtained with the consent of a relevant parent or responsible adult; and is not subject to any other contract, agreement or license.
2. PHOTO RIGHTS: By submitting your photo, you give Football Fanatics and its affiliates a worldwide, royalty-free, non-exclusive, transferable and non-revocable right and license to use, reproduce, display publicly, modify, adapt, edit, publish, translate, distribute, perform, play, create derivative works from, exercise and sub-license all associated and relevant rights (including intellectual property rights and publicity rights) with respect to your photo in any media whatsoever, whether now known, or developed in the future (the foregoing license is granted for the entire respective terms of the relevant rights); and to the extent permitted by law, unconditionally and irrevocably waive all moral rights which you may have in your Material.
3. EDITING: Football Fanatics will audit the photos to make sure the content suits our terms and conditions. Football Fanatics reserves the right to delete any photos from the site for any reason. In the event Football Fanatics decides to post your photograph, Football Fanatics reserves the right to edit, crop and/or alter the photo in any way it sees fit, consistent with the rights granted above. Football Fanatics reserves the right to not allow certain users to post photos.
4. NO SOLICITING: You agree not to use the site to advertise non Football Fanatics products or services or to solicit anyone to buy or sell products or services, or to make donations of any kind, without our express written approval.
5. PRIVACY: Without limiting the generality of our usage rights under these rules, by submitting your photo, you also agree to Football Fanatics' use of your personal information as described in Football Fanatics' Privacy Policy at http://www.footballfanatics.com/HelpDesk/Privacy_Policy.
6. LIMITATIONS OF LIABILITY: Football Fanatics is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in Fanatic Photos or by any technical or human error which may occur in the processing of submissions. You expressly agree that use of Football Fanatics' Web site is at your sole risk.
7. COMPLIANCE WITH CHILDREN'S ONLINE PRIVACY PROTECTION ACT (COPPA): You represent and warrant that, in compliance with COPPA, you are over thirteen (13) years of age.
8. APPLICABLE LAW; CONSENT TO JURISDICTION: The Football Fanatics site, as well as its affiliate's sites (excluding linked sites) is controlled by Football Fanatics from its offices within the state of Florida in the United States. By submitting your photo, both you and Football Fanatics agree that the statutes and laws of the state of Florida, without regard to the conflict of laws principles thereof, will apply to all matters relating to Fanatic Photos, or other use of the Football Fanatics site. You agree that exclusive jurisdiction for any dispute with Football Fanatics resides in the courts of the state of Florida and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the state of Florida in connection with any dispute including any claim involving Football Fanatics or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers. This site may be subject to additional federal, state or local laws.
9. SEVERABILITY: If any provision of these terms and conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
